    Former county attorney, circuit court judge of Brown and Johnson counties and county resident Robert B. Lybrook, 67, of Martinsville, died on Monday, August 3, 1981 at Methodist Hospital in Indianapolis where he had been hospitalized for three weeks. He had been in failing health since April.
    Lybrook was born on January 11, 1914 to B. H. and Hazel H. Todhunter Lybrook in Gary and received his early schooling in northern Indiana and Ohio.
    He graduated in 1932 from Arsenal Technical High School in Indianapolis and on April27, 1940, married Josephine Elizabeth Miller, who survives.
    Receiving a bachelor's degree in journalism and then in 1937 receiving a law degree, both from Indiana University, Lybrook was admitted to practice before the Indiana Supreme Court in 1937.
    A World War II Navy veteran, he practiced law in Franklin from 1945 to 1954 before serving as judge of the Eighth Judicial Circuit Court of Brown and Johnson counties from 1954 to 1967.He then practiced law in Nashville from January 1967 until January 1972 and moved from Brown to Morgan County in 1973.
    From 1972 he served as judge on the First District Indiana Court of Appeals until September 1979, when he retired.
    Other public positions he held were prosecuting attorney for the Eight Indiana Circuit Court of Johnson and Brown counties from 1946 to 1950 and county attorney for Johnson and Brown counties.
    His professional memberships were Indiana Bar Association, Indiana Judges Association, American Judicature Society, and county bar associations in Brown, Johnson and Morgan counties.
    He was also a member of Nashville and Franklin Masonic lodges, of which he was past master; Franklin Elks, of which he was a past exulted ruler; Scottish Rite; Valley of Indianapolis; Murat Shrine; American Legion; and Sigma Chi fraternity.
    Lybrook is also survived by a son, Robert E. Lybrook of Martinsville; two daughters, Jo Katherine Durkott of Indianapolis and Mary Elizabeth Phariss of Bourbonnais, Illinois; a brother Philip Lybrook of Venezuela; and six grandchildren.
    A sister preceded him in death.
    Rev. John Cheesman officiated at the funeral service on Thursday at Neal and Summers Funeral Home in Martinsville with burial at Washington Park East in Indianapolis.
